SAN FRANCISCO – The Ninth Circuit vacated dismissal of a qui tam complaint accusing United Healthcare Insurance Co., WellPoint and other Medicare Advantage organizations of submitting false certifications in violation of the False Claims Act, and remanded with instructions to allow James Swoben to file a fourth amended complaint.
