Retraction

An article published in the January 22, 2014 edition of this page under the headline "Tribal Payday Loan Outfits Buck California," which reported on an appellate court ruling that involved tribal sovereign immunity and payday loan companies, contained incorrect information about Scott Tucker. Contrary to what was reported in the article, Mr. Tucker does not face racketeering class actions in Kansas. Although a class action complaint alleging racketeering was filed against Mr. Tucker in the United States District Court for the District of Kansas in April 2012, that action was dismissed at the motion-to-dismiss stage in November 2012 without being certified as a class action. Mr. Tucker does not face any other racketeering class action in Kansas. In addition, Mr. Tucker does not face state enforcement actions for illegal payday loan practices in Georgia, nor has he in the past. The article incorrectly linked to an earlier Courthouse News article reporting on the July 2013 filing, by the State of Georgia, of an action against payday lenders CashCall and Western Sky Financial, together with Western Sky owner Martin A. Webb. Mr. Tucker was not a defendant in that lawsuit, and Mr. Tucker is not associated with Western Sky Financial, CashCall or Mr. Webb. Courthouse News has removed the article from its database and deeply regrets the errors.
