Residency Challenge|Roils Missouri Election

ST. LOUIS (CN) — A Missouri appeals court revived a challenge to a lawmaker's residency, just weeks before the general election.

At issue is whether state Rep. Keith English lives in Florissant, a suburb of St. Louis next door to Ferguson, rather than Jefferson City, the state capital, 125 miles away.

Jermond "Jay" Mosley, of Florissant, English's opponent, filed the residency challenge. Mosley claims English lives in Jefferson City, not the rental house he lists as his voting address in Florissant.

English was elected as a Democrat, but became the Legislature's lone independent member in 2015. Mosley is running as a Democrat.

Members of the Missouri Legislature must live in the district they represent, under the state constitution.

St. Louis County Circuit Judge Joseph Dueker dismissed Mosley's challenge in September, finding it was not filed in a timely manner.

But on Friday, the Missouri Court of Appeals for the Eastern District revived it, finding Mosley had beaten a 5-day deadline, based on when the courts were open that week. The appeals court remanded it.

A date for the next court action was not immediately available Tuesday.
