Records Action Against USDA Is Moot, Court Says

(CN) - The 7th Circuit refused to declare the U.S. Department of Agriculture in violation of the Freedom of Information Act, because the agency has since turned over documents that the Cornucopia Institute fought to obtain.

Cornucopia filed suit after the agency missed three deadlines to hand over public records.

But because the agency eventually complied, the Chicago-based federal appeals court ruled that the case is moot.

"It is well established that the federal courts have no authority to rule where the case or controversy has been rendered moot," Judge Kanne wrote.

"Cornucopia does not seek any response to its FOIA request beyond what it already received, nor does it claim to be entitled to damages," the judge added.
