Rapper Jay Z Sued in Trademark Action

ATLANTA (CN) - Rap music mogul Jay Z is being sued for trademark infringement in federal court.

The plaintiff, I Will Not Lose LLC, is claiming the defendant, also known as Shawn Carter, as well as Iconix Brand Group Inc. have adopted the identical mark, I Will Not Lose. The mark is used on the Rocawear clothing, which was developed by Carter and is owed by Iconix, according to the complaint. The plaintiff believes that Carter continues to, at least in part, manage the Rocawear product line development.

Under the direction of Carter, the advertising campaign for the new I Will Not Lose product line includes a Web site, iwillnotlose.org, which features personal stories from other famous recording artists like Ciara and Chris Brown "sharing their personal stories of overcoming various challenges or obstacles in life and thereby reciting the statement, "I Will Not Lose."

Robert Ward of Myers & Kaplan Intellectual Property Law LLC is representing the plaintiff.
