Quibbling over quarters

HOUSTON — An appeals court in Texas reversed the trial court’s damages and attorney fees award in favor of an orthopedic surgeon who brought a contract claim against his professional association. His share of expenses was consistent with his employment contract, which divides expenses evenly among the four surgeons. The jury was wrong to find the parties’ agreement, according to which he was responsible for 25% of the share, was ambiguous.
