Questionable Witness ID Heads to Supreme Court

(CN) - The Supreme Court on Tuesday agreed to review the admissibility of a witness identification in a case where the suspect was already in handcuffs.

Barion Perry was convicted of breaking into a car in 2008. A witness identified Perry when the police had him in handcuffs, but she later failed to describe him or to pick his photo out of a lineup.

The New Hampshire Supreme Court refused to toss the identification.
