Pull the Other One, Class Tells KMart

BELLEVILLE, Ill. (CN) - KMart's "Germ Defense" product does not "'boost your immune system,' or provide users with any other health benefits, despite KMart's false representations to the contrary," a class action claims in St. Clair County Court.

KMart pushes the product to compete with Airborne Health's "Airborne."

"KMart's representations of the medical efficacy of Germ Defense are false," the complaint states. "Germ Defense does not boost the immune system, it offers no protection against germs, it provides no health protection in crowded environments and has no effect on getting or remaining sick."

The "Illinois-only class action" demands damages for consumer fraud, unfair and deceptive trade and unjust enrichment. Class counsel includes Becker, Paulson, Hoerner of Belleville and Freed & Weiss of Chicago.
