MIAMI – The Florida Third District Court of Appeal ruled that white men are a protected class.
In this criminal case in which the defendant was found guilty of trespass of a conveyance – the lesser included offense of grand theft of an automobile – the state’s peremptory challenge of a white male juror was improper, because white men are part of the protected class of “gender.”
