New ‘Targets’ Invoked to Protect Evidence in NY-NJ Bombing Probe

A prosecutor pursuing charges against accused New York and New Jersey bomber Ahmed Rahimi sought to protect evidence that could implicate “an investigation of some targets that are domestically located,” at a hearing on Monday.

MANHATTAN (CN) — A prosecutor pursuing charges against accused New York and New Jersey bomber Ahmed Rahimi sought to protect evidence that could implicate “an investigation of some targets that are domestically located,” at a hearing on Monday.

The revelation came as Rahimi’s lawyers challenged the prosecutor’s attempt to shield the evidence as confidential, in a case involving bombings that injured dozens in mid-September.

Assistant U.S. Attorney Emil Bove told the court that “discovery is going to include materials that do relate to ongoing investigations.”

This could also include “materials that could be used by others to create other situations that compromise public safety and national security, and what I am talking about here are follow-on attacks,” the prosecutor added.

Rahimi’s defense attorney Sabrini Shroff expressed her willingness to sort through which information requires protection.

“We are still willing, we are still open, and we see no downside to sitting down, reviewing documents, and coming back and saying, okay, look, you are right,” said Shroff, suggesting keeping the information in the hands of security-cleared counsel.

After meeting with attorneys in his chambers, U.S. District Judge Richard Berman asked the parties to try to work out the issue by the end of the day on Tuesday.

If not, the topic will likely arise again at a status conference on Dec. 19.

Trial is currently scheduled for March 27, 2017.
