Prosecutor Has Immunity In Grant-Fraud Case

CINCINNATI (CN) - The government and a federal prosecutor cannot be sued for prosecuting a man for allegedly making false statements on his application for a $390,000 grant to research and develop a process for recycling ink, the 6th Circuit ruled.The charges were dropped for lack of evidence, but the circuit threw out Thomas Dolan's malicious prosecution claim because the federal prosecutor had acted within the scope of his employment.
