BERKELEY, Calif. (CN) - A promoter claims DiLeo Entertainment swiped $171,000 by falsely claiming it had "exclusive rights" for an "Eddie Griffin & Jamie Foxx Comedy Tour." BJK Entertainment claims DiLeo lied about the comedy tour and refused to return the money.
BJK sued DiLeo Entertainment Group, DiLeo Entertainment and Tour, DiLeo Entertainment & Touring, and business partners Mark Lamika and Frank DiLeo -Michael Jackson's former manager - in Alameda County Court.
BJK claims that in 2008 DiLeo claimed to represent comedians Jamie Foxx and Eddie Griffin. It says that in a "binder agreement," DiLeo granted BJK "exclusive rights to production, marketing, promotion, sponsorship and market deals in conjunction with the Eddie Griffin & Jamie Foxx Comedy Tour," which would run through 2009.
BJK says it paid $251,000 for those rights.
But it claims that DiLeo did not have authority to "act on behalf of Eddie Griffin & Jamie Foxx," and "misrepresented that there would be a comedy tour at all."
BJK says DiLeo returned $80,000 but refused to hand over the remaining $171,000.
BJK wants the $171,000, and punitive damages for breach of contract, breach of fiduciary duty, fraud, unjust enrichment and misappropriation.
