Promoter Claims Gucci Mane Defrauded Him

LAKELAND, Fla. (CN) - Southern rapper Gucci Mane took money for Florida shows he knew his probation travel restrictions would not let him perform, a promoter claims in a racketeering complaint.

Stephen Gold sued the rapper, whose real name is Radric Davis, in Hillsborough County Court. He also sued three promoters, producers and booking agents and two of their executives.

Gold claims he lost $445,079 when Davis/Gucci failed to perform at two concerts in 2009.

"These concerts were canceled because Gucci was restricted from leaving the state of Georgia under conditions of his probation stemming from a felony assault in 2005, and for his subsequent violations of those conditions," Gold says in the lawsuit.

"Despite knowledge of these travel restrictions and subsequent probation violations, defendants engaged in a widespread scheme scheduling concerts they knew would not take place, including the concerts involving Gold that are the subject of this complaint."

Gold claims the rapper agreed to perform at a concert in October 2009, then rescheduled it to November 2009, and offered to attend an after party for an additional fee.

Before any of it happened, though, Gold says, he learned via the Internet that Gucci was not allowed to leave Georgia.

And, Gold says, Gucci and his co-defendants refused to refund his $24,000 deposit plus $175,650 in expenses.

"Defendants' failure to refund plaintiff's deposit is evidence that defendants intended to either temporarily or permanently deprive Gold of his money," the complaint states.

Gucci was convicted in October 2005 of two counts of aggravated assault and received a 7-year sentence, for which he served 6 months in jail and the rest on probation, according to the complaint.

Gucci violated his probation a year later, and his conditions were changed to require that he obtain travel permits, the complaint adds.

Gold claims Gucci spent the remaining years of his probation in and out of jail for continual probation violations. Gucci is in jail now, according to the complaint.

Also named as defendants are Gucci's production company So Icey Entertainment, booking agent Mizay Entertainment, its officer Johnnie Cabbell, Gucci's management company Hitt Afta Hitt Entertainment, and its officer Debra Antney.

Antney is named as a defendant throughout the complaint, but not in the header of the complaint.

Gold demands $445,079 and punitive damages for RICO fraud, wire fraud, common law fraud, civil theft, breach of contract, unjust enrichment and conversion.
