Profane protest protected

TAMPA — A Florida federal judge refused to dismiss a First Amendment retaliation claim brought by a protester who was cited by an officer and ordered to leave the sidewalk for displaying “Fuck Trump” and “Fuck Biden” flags and wearing a shirt reading “Fuck Policing 4 Profit.” The now-defunct Punta Gorda city ordinance banning the display of obscene signs did not specifically cite “fuck” as a prohibited word and the Supreme Court has explicitly held that the simple display of the expletive can’t be made a criminal offense, so the officer is not entitled to qualified immunity.
