Producers of ‘Easy Rider’ Sequel Win Fraud Appeal

(CN) - The producers of a sequel to the movie "Easy Rider" did not defraud the estate of a deceased investor, the Missouri Court of Appeals ruled.

Alfred H. Kerth III invested in Polestar Entertainment's proposed sequel to the iconic 1969 film, which starred Dennis Hopper and Peter Fonda.

Kerth invested $125,000 in the production of the sequel. He died in 2002, and his lawyers discovered the agreement in 2004.

Kerth's widow, Susan Kerth, sued Polestar Entertainment, Glenn Tobias and Besdine Management Co. for fraud. The trial court sided with Kerth in 2007, but the appeals court overturned the decision.

"Because the defendants were not notified of the 2007 trial setting, the defendants' due-process rights were violated and the trial court's judgment must be set aside as void," Judge Lawrence Mooney wrote.
