MANHATTAN (CN) - In a state class action, a diehard Yankees fan says Steiner Sports sold seats from the old Yankee Stadium - at $1,500 a pair - that were not what they were claimed to be. John Lefkus says he paid the money, plus an extra $500 to be sure he got the seats that he "sat in regularly for 23 years," but didn't get them.
Lefkus claims that Steiner Sports already has sold about 3,000 pairs of seats and intends to sell 15,000 pairs.
He claims Steiner promised that the seats "have not been refurbished in any way" but his seats, which he knows well, had been "stripped and the seats were repainted in a different hue from original."
He says he investigated, and found that the seats had been "dismantled in the process of demolition of the stadium," and the components had not been "properly catalogued or organized."
"As a result, seats sold as authentic were furbished and original Yankee Stadium seats were simply new pairs of seats constructed with a combination of new hardware and repainted parts of old seats and seatbacks and bottoms," Lefkus claims in New York County Court.
He says his seats came with a "Yankees-Steiner Collectibles Letter of Authenticity" and were stamped with a Major League Baseball hologram said to be "tamper-proof."
"In fact, the seats are tampered with - completely dismantled and reassembled with various other parts some of which never resided in Yankee Stadium - prior to the holographic tagging," the complaint states.
He demands punitive damages for deceptive business practices, false advertising, unjust enrichment and breach of warranty.
