SAN FRANCISCO - A magistrate judge tossed a complaint filed by the survivors of a man allegedly killed by police, saying they failed to adequately specify who the actual plaintiffs are and whether they are suing the police defendants in their individual or official capacities or both. U.S. Magistrate Judge Laurel Beeler will allow the plaintiffs to file an amended complaint within 21 days.
