SAN FRANCISCO — The Ninth Circuit upheld the denial of qualified immunity sought by Riverside County Sheriff’s Department Sergeant Dan Ponder in a suit alleging he used excessive force when he shot Clemente Najera-Aguirre six times without warning, killing him.
