Two Birmingham police officers are not entitled to qualified immunity in a malicious prosecution suit brought by a man who spent 16 months in jail on attempted murder charges based on the officers’ claims that he pointed a gun at them, the 11th Circuit ruled.

BIRMINGHAM, Ala. — Two Birmingham police officers are not entitled to qualified immunity in a malicious prosecution suit brought by a man who spent 16 months in jail on attempted murder charges based on the officers’ claims that he pointed a gun at them, the 11th Circuit ruled. Dashboard camera video shows the man had dropped his gun and complied with officer’s commands. One of the officers shot the man twice.
