Huntington Beach police officers were entitled to immunity in a mother’s suit stemming from the fatal shooting of her son by police after he brandished a sharp stick and was “haphazardly moving” at people on a soccer field, the Ninth Circuit ruled.

PASADENA, Calif. – Huntington Beach police officers were entitled to immunity in a mother’s suit stemming from the fatal shooting of her son by police after he brandished a sharp stick and was “haphazardly moving” at people on a soccer field, the Ninth Circuit ruled.

However, the circuit court determined the lower court improperly granted judgment to the defendants on the mother’s California law battery and negligence claims.
