Police misconduct suit survives

AUSTIN, Texas — A federal judge in Texas allowed most of a mother’s claims to proceed in her lawsuit against an Austin police officer and the city after her son was killed by police who gave him conflicting orders before shooting him dead. She adequately alleged this was excessive force and that the city has chosen not to investigate previous such incidents or discipline officers involved in using excessive force.
