Police chief not captain’s ‘employer’

RICHMOND, Va. — The Virginia Court of Appeals held that, where a Waynesboro fire police captain sued for retaliation under the Virginia Fraud and Abuse Whistle Blower Protection Act, the city is entitled to sovereign immunity but the police chief is not. The chief cannot be sued for retaliation under a portion of the statute, however, because he wasn’t the captain’s “employer” under state law. The captain’s whistleblowing claim may proceed, however.
