NEW ORLEANS — The Fifth Circuit denied a Texas high school teacher’s petition for an en banc rehearing after a three-judge panel of the court found he is not entitled to qualified immunity on First Amendment claims brought by a former student. The student claims he punished her for refusing to participate in an assignment that required her to transcribe the Pledge of Allegiance.
