Permit Compliance for|Chemical Makers Stayed

WASHINGTON (CN) - The chemical manufacturing facilities that emit greenhouse gases and had installed a control device to limit emissions after Nov. 15, 1990, will not have to submit a Title V permit application to continue operations as the Environmental Protection Agency continues to reconsider its Title V permit requirements.

The American Chemistry Council and the Society of Chemical Manufacturers and Affiliates petitioned the agency stay the requirements to submit petitions while reconsideration of the requirements was underway because of the expense involved in filing an application that an emitter might not be required to submit after the agency reconsideration is complete.

Title V of the Clean Air Act requires that all major source emitters of greenhouse gases obtain operating permits before beginning new operations or resuming operations after a major remodel. Most Title V permitting is carried out by state and local authorities but the EPA retains control permitting for the chemical manufacturing industry.
