Pelvic Mesh

In a negligence case against C.R. Bard for its pelvic mesh product, a federal judge has asked the Third Circuit to resolve “whether Pennsylvania recognizes a strict liability claim for a manufacturing defect of a prescription medical device.”

PHILADELPHIA — Citing conflicting opinions, a federal judge certified to the Third Circuit a negligence claim against C.R. Bard for its pelvic mesh product, asking “whether Pennsylvania recognizes a strict liability claim for a manufacturing defect of a prescription medical device.” More than 800 lawsuits have been filed about the device.
