Patient Says Doc And Insurer Conspired

MANHATTAN (CN) - An insurance company conspired with a doctor whose office did chest surgery on a man injured in an auto accident, by hiring the doctor as an expert witness in the man's claim against the other driver in the head-on collision, Jack Woods claims in New York County Court.

Woods says he spent 11 days at North Shore University Hospital, where he underwent chest surgery by Dr. Lawrence Glassman, whose cardio-thoracic group included Dr. Gary M. Kline, a defendant in this case.

Woods sued the driver of the Jeep that crashed into him. As the case against that driver, Pavlovich, proceeded, Woods says, Progressive Insurance Co., representing the Jeep driver, hired Dr. Kline as an expert witness for the driver's defense. He claims Progressive "based its entire preparation of the cardio-thoracic issues in the Pavlovich Action around the information supplied to them by Dr. Kline".

Woods claims Progressive's cross-examination of Dr. Glassman "was based upon discussions and meetings with Dr. Kline. ... (and that) Dr. Kline did not report to the Group that he had been engaged by [defense counsel] Brand / Progressive in the Pavlovich Action". And he claims that "Dr. Kline, in fact, was dismissed from the Group as of Jan. 1, 2008, based upon similar transgressions".

Woods demands punitive damages for conspiracy, negligence, breach of duty and other charges.
