Parents Say Kid Was|Duct-Taped on School Bus

BELLEVILLE, Ill. (CN) - A school bus monitor and driver conspired to duct tape a student's arms during a ride to school, parents claim in court.

Robert Wainner and Kristina Miller sued Durham School Services, bus monitor Gertrude Gebhart and bus driver Charles Witthofft, on behalf of their son, A.W., in St. Clair County Court.

"On the morning of April 24, 2012, Gebhart restrained A.W.'s arms and body with duct tape in the presence of, and with full knowledge and consent of, Witthofft," the complaint states.

The parents claim their son suffered physical and mental injury.

The lawsuit cites no reason for the alleged duct-taping.

The family seeks damages for negligence, strict liability, battery, assault and civil conspiracy. They are represented by Clay B. St. Clair, with Crowder & Scoggins, in Columbia, Ill.
