Parents Say Cops Needlessly Killed|Their Tripping, Unarmed Son

PORTLAND, ORE. (CN) - Parents say a deputy sheriff needlessly shot to death their unarmed, 120-lb. son who was tripping on mushrooms. Officers Tasered Jordan Case three times before Washington County Deputy Glenn Howard, after accidentally Tasering himself, needlessly shot Case three times in the chest and once in the head, the parents say in Federal Court.

Case's parents say Deputy Howard used excessive force when he shot and killed their son, who had emerged from a neighbor's apartment he had entered while under the influence of hallucinogenic mushrooms. Emergency dispatchers failed to tell officers that Case was on mushrooms, the complaint states.

After being subdued by his female neighbor, Case ran outside, where a standoff occurred with Deputy Howard, and officers from the cities of Tualatin and Sherwood, the parents say. They say Howard and the other officers used excessive force when they Tasered their son and shot him with beanbags. After accidentally Tasering himself, Howard shot Case three times in the chest and once in the head when Case approached an officer's patrol car, the complaint states.

The Washington County district attorney cleared the officers of wrongdoing about one month after the October 2006 shooting.

Represented by Steven Sherlag, the Cases seek punitive damages for constitutional violations, assault and battery and wrongful death.
