Paramount Owes It $3.75 Million for|’No Country for Old Men,’ Funder Says

LOS ANGELES (CN) - Marathon Funding Co. claims Paramount Pictures owes it $3.75 million for the movie "No Country for Old Men." Marathon claims it owns 25 percent of the movie, and Paramount breached contract by deducting the money for an "extra $15 million" owed to the movie's star, Tommy Lee Jones.

In its Superior Court complaint, Marathon, a Delaware corporation, says it owns 25 percent interest in the copyrights of "a number of motion pictures" produced by Paramount.

Paramount produced and distributed the movie, and owes Marathon 25 percent of the net revenue from distribution, Marathon says.

Marathon says that when it got its check in March for its 25 percent cut for the period ending on Jan. 31, Paramount had deducted $3.75 million, "constituting 25 percent of an extra $15 million payment, over and above the normal third party participation due to Jones".

Marathon claims that Paramount paid Jones under protest, claiming that "the extra $15 million payment was not due to Jones."

But "When Marathon complained to Paramount concerning this charge, Paramount refuse to reverse it or modify it."

Marathon says the payments to Jones are Paramount's problem. It wants its $3.75 million, and punitive damages for breach of fiduciary duty. Marathon is represented by Hillel Chodos.
