ST. LOUIS (CN) - Outback Steakhouse failed to control an unruly patron who threw a glass that hit a woman in the face, the woman claims in City Court.
Annette Maschmeier says her waitress and an Outback manager did nothing after she complained about defendant Natasha Hernandez's foul language.
She claims the manager refused to let her and her family move to a different area of the restaurant.
"Hernandez and others in her party, who were intoxicated, began to use even more foul language and called plaintiff and her family foul and vulgar names," the complaint states. "Defendant Outback still refused to address the situation.
"Hernandez and others in her party then threatened plaintiff and her family and still Outback refused to address the situation.
"Maschmeier then announced that she was going to call the police, at which time defendant Hernandez announced that she was going to 'fuck her up' and 'Bitch, I will fucking take you down' and then threw a glass which struck her in the head. Defendant Outback still refused to address the situation."
Maschmeier sued Hernandez and Outback Steakhouse of Florida LLC.
She seeks actual and punitive damages for personal injury.
