CINCINNATI — With the exception of a contingent of California attorneys, the Sixth Circuit upheld an award of attorneys' fees that Ohio must pay after trying unsuccessfully to undo a federal consent decree over its election rules.
The defeat for Ohio meant that, during the 2012 presidential election, it had to continue counting provisional ballots cast by voters who appeared in the correct polling location but lacked certain identification. Another provision of the consent decree that Ohio had been unsuccessful at avoiding required the state to count ballots cast in the right polling place but wrong precinct due to poll-worker error.
