Officers Immune For Detention In SIDS Case

ST. LOUIS (CN) – The 8th Circuit granted qualified immunity to Des Moines police officers who detained and questioned a father on suspicions of child abuse while his wife took their infant to the hospital, where he died from what was later deemed Sudden Infant Death Syndrome.

The court said the decision to detain the father was “fairly unintrusive” in the context of an investigation of a child’s death.
