Office Park Is Fed Up With Abortion Clinic

MARIETTA, Ga. (CN) - A medical clinic that offers abortions is creating a nuisance for its neighbors, tenants of the office park claim in court, saying protesters deter business.

The Governors Ridge Office Park Association and its member property owners sued Alpha OBGYN Group PC, Daniel McBrayer Sr. and The McBrayer Family LP in Cobb County Superior Court.

McBrayer operates a medical practice out of Building 23 in the Marietta office park that specializes in "terminating human pregnancies" during regular business hours, according to the complaint.

The other building owners claim that the practice attracts "a constant stream of 'right to life' picketers and demonstrators who, at times, trespassed onto the common and private areas of Governors Ridge, at times loudly, bellicosely and threateningly accosted visitors and invitees of Governors Ridge."

Faced with indiscriminate threats, prospective visitors, invitees and customers of the office park are allegedly discouraged from entering or returning to the premises.

In addition to the negative "word of mouth" and bad publicity, the abortion clinic was the site of a suspicious fire in May 2012, according to the complaint.

"That suspected crime has caused tenants and owners of Governors Ridge to fear for their personal safety and that of their property," the complaint states.

The building owners say there is no end in sight to the negative effects that McBrayer's clinic has on the office park.

After a November 2009 hearing, the office park's board allegedly determined that McBrayer's business "constituted a continuing private nuisance."

The board says it ordered McBrayer to "cease and desist from maintaining the nuisance they created and maintained."

McBrayer nevertheless "deliberately flouted that demand," the complaint states.

The plaintiffs blame the continuing nuisance for interrupting the sale of a building, diminishing property values and scaring away customers.

Governors Ridge Office Park Association and the owners want an injunction, punitive damages and attorneys' fees. They are represented by Alexander LeVorse and Daniel Gavrin, both of Atlanta.
