Obama Looks to Revoke Bush Era Exemption

WASHINGTON (CN) - President Obama is likely to revoke a Bush administration midnight regulation which allows executive departments and agencies considering an action that might affect endangered species to avoid consulting with the Fish & Wildlife Service or the National Marine Fisheries Service beforehand.

The FWS and NMFS have the scientific and technical expertise needed when considering such actions, and are the ones with primary responsibility to ensure that the Endangered Species Act is implemented in accordance with the law.

Obama has asked the Secretaries of the Interior and Commerce to review the regulation their departments put into place in December, with an eye to restoring the previous practice of consultation. In the meantime Obama has directed agency and department heads to consult with each other in a manner that reflects the goals of the ESA.
