CARSON CITY, Nev. (CN) - Prosecutors in O.J. Simpson's armed robbery and kidnapping conviction can defend against his appeal to be released from prison, the Nevada Supreme Court ruled.
The state's highest court denied Simpson's appeal to disqualify the Clark County District Attorney's Office from handling the appeal.
Simpson's attorney said that the current district attorney, Steve Wolfson, is married to the Judge Jackie Glass, who handled Simpson's trial in 2008.
The decision upholds this year's decision by Judge Kathleen Delaney, who ruled that Wolfson didn't stand to benefit from the outcome of the appeal.
Wolfson became district attorney this year; Glass resigned in May 2011.
Wolfson, a former defense attorney, never represented Simpson.
Simpson, 65, was convicted in 2008 of leading a hotel room heist with five other men - two of them armed - to take sports memorabilia from a pair of dealers.
Simpson was sentenced to 9 to 33 years in state prison.
His attorneys claimed during trial that Simpson wanted to retrieve family photos and mementos he said were stolen from him after he was acquitted in 1995 of killing his former wife, Nicole Brown Simpson, and her friend, Ronald Goldman.
