(CN) - A New York appellate division turned down Purr Fect World's request to compel local safety inspectors to inspect its cat shelter, which was shut down after authorities discovered 278 cats in deplorable conditions - many were dead, sick or malnourished.
The shelter was shut down in May 2007, and was found guilty of 28 agricultural violations.
In August 2007, the petitioner twice asked for an inspection of the shelter in hopes of reopening the business. At the same time, the petitioner was sentenced to a one-year conditional discharge, including the condition that it not operate a cat shelter.
The New York Supreme Court's 3rd Appellate Division found that the petitioner "failed to exhaust the administrative remedies offered under the City of Courtland Zoning Ordinance." The case was dismissed.
