Noxious Odors

A federal court in New York ruled that a proposed class action’s negligence claims against a waste management company may continue. A property owner alleges noxious odors emitted from a landfill damaged nearby homes and rental properties. 

ROCHESTER, N.Y. – A federal court in New York ruled that a proposed class action’s negligence claims against a waste management company may continue. A property owner alleges noxious odors emitted from a landfill damaged nearby homes and rental properties. 

However, the court ruled that the property owner failed to detail the scope of the affected community required to maintain a nuisance claim.
