LAS VEGAS (CN) - Cy Coleman's estate wants Rep. Dean Heller to stop using the songwriter's Broadway classic, "Big Spender," in attack ads. Coleman's estate, Notable Music, says it refused the freshman Republican congressman's request to use the song in his re-election ads, but Heller used it anyway.
"The authors of the music never intended the composition to be used for political purposes," the lawsuit says of the song from the 1966 show, "Sweet Charity."
Heller is using the tune's lyrics to portray his Democratic opponent, Jill Derby, as a "big spender." The estate wants the distribution of the tune enjoined, disgorgement of profits and costs and fees. It also sued Weeks & Co., of Texas, which made the ad.
Coleman's estate is represented by Mark Borghese of Weide Miller.
