(CN) - A corrections officer who was hurt on the job can't collect additional workers' compensation for car accident injuries she suffered during her 130-mile trip to the doctor's office, a California appeals court ruled.
Tania Esquivel was receiving treatment at a medical office eight miles from her home. After visiting her mother in San Diego, she was hurt on the way to the medical office after she drove through a stop sign and crashed.
Workers' compensation granted her benefits from these new injuries, in addition to her previous benefits. Her employer and its insurer objected, and the trial court ruled in their favor.
The Fourth District Court of Appeal in San Diego agreed that the accident occurred too far from Esquivel's workplace to be covered by workers' compensation.
"Esquivel's new injuries are not compensable ... because they clearly occurred outside the reasonable geographic area of her employers' compensability risk," Justice Nares wrote.
