Ninth Circuit remands unfair wage claims against restaurant chain

SAN FRANCISCO — The Ninth Circuit vacated dismissal of a fair wage advocacy group’s claims against Darden, the owner of such restaurant chains as Olive Garden and Longhorn Steakhouse, finding that the lower court did not address the group’s Article III subject-matter jurisdiction. This must be done before the circuit court can decide the question before it: whether the group has statutory standing to sue.
