(CN) - The clock expired on an NFL alumnus' medical malpractice lawsuit in which he claimed to have been placed under anesthesia for longer than expected.
Matt Stinchcomb played on the offensive line for the Oakland Raiders and Tampa Bay Buccaneers for eight years. Oakland drafted him in the first round in 1999 as an All-American from the University of Georgia.
He underwent lumbar disc surgery in 2005, when he was on the Tampa Bay roster.
The procedure took longer than expected when his dura mater (covering of the spinal cord) was injured during the procedure.
Four days after he left the North Carolina medical facility, he suffered a pulmonary embolus and went into a hospital in Tampa.
Stinchcomb filed a medical malpractice lawsuit in 2009 against Presbyterian Medical Care Corp., Dr. Craig D. Brigham and several other defendants.
However, the trial court dismissed his case as untimely, and Judge Linda Stephens of the North Carolina Court of Appeals affirmed the decision.
"Because the statute of limitations expired the day after Plaintiff filed his complaint, and Plaintiff failed to issue timely summonses to defendants, Plaintiff failed to commence his action against the Defendants within the statute of limitations.
After his playing career ended, Stinchcomb went on to work as a college football analyst for ESPN. He also started the Stinchcomb Family Foundation, which raised money for children's charities in Georgia and Florida.
