CLEVELAND (CN) - The wife of NFL quarterback Jeff Garcia says a nightclub used her photo without permission in ads circulated throughout the city. Carmella DeCesare Garcia, who was Playboy's 2004 Playmate of the Year, sued Sin Night Club, and First Class Mobile DJ Service, which allegedly made the ads, in Cuyahoga County Court.
Garcia also sued Gordon Stojkowski, who owns the Cleveland nightclub, and Tony Stojkowski, who owns First Class Mobile, according to the complaint.
Garcia seeks punitive damages for privacy invasion, negligence, unjust enrichment, and unauthorized commercial use of her persona.
