LOS ANGELES (CN) - A longtime news and video editor says CBS Broadcasting made him suffer a "catastrophic loss in workload" after he complained about what he felt was an unfair system of rating editors.
Rogelio Lobato says in his Superior Court that he's worked at CBS since 1989. He says CBS performed an unfair "productivity analysis" in 2008 that "rated editors based on the average turnaround time for each job assigned to the editor." Lobato says that he ranked 11 out of 26 editors, but complained that the rating system "tended to unfairly rate the more experienced and older editors because the experienced and older editors often received the more complex work."
Lobato also complained that the ratings were unfair because they "did not fairly account for the time that some editors spent editing off the clock." The unpaid work improved those editors' job ratings, Lobato said.
He says he suffered a "catastrophic loss" of work after complaining, and received no work at all from the supervisor to whom he complained, Doug Dougherty. And he says it took CBS 9 months to investigate his complaints of retaliation and denial of work, and that CBS' finding that he had not suffered retaliation was further retaliation.
Lobato demands punitive damages, claiming wrongful denial of employment and retaliation. He is represented by Patricio Barrera of Manhattan Beach.
