New York cannabis

ALBANY, N.Y. — A federal court in New York declined to enjoin the state from issuing new licenses to operate retail cannabis dispensaries. New York’s early-entry application process does not violate the dormant commerce clause because the clause does not guarantee a right for dispensaries to participate in an interstate market, which Congress declared illegal. The injunction would seriously harm the state’s adult use cannabis industry.
