New York Appellate Divisions

ATTORNEYS - The New York Appellate Division disbarred attorney Arthur L. Schwartz because he pleaded guilty in federal court to two felony counts of making false statements regarding tax returns and failed to timely inform the Disciplinary Committee of his conviction.

The federal offense is analogous to a conviction of the New York felony of offering a false instrument for filing in the first degree, warranting automatic disbarment.

ATTORNEYS - The New York Appellate Division suspended attorney Jeanette G. Stewart for an indefinite period on the ground that she is incapacitated by a mental illness. An interim suspension was imposed after a judge complained about her erratic behavior and she failed to cooperate with the Departmental Disciplinary Committee's investigation of the complaint. Four years later, after she finally submitted to a lengthy psychiatric examination in her attorney's office, the committee's expert concluded that she suffers from a mental illness that will continue to interfere with her ability to practice law, and she failed to supply an expert opinion to contradict that determination.

ATTORNEYS - The New York Appellate Division affirmed the judgment and grants the motion of the defense attorney to withdraw from the case because there are no non-frivolous points that could be raised on appeal. People v. Colon
