(CN) - The former CIA officer accused of leaking defense secrets to a New York Times reporter has asked a federal judge to accept new evidence into the record, the first development in the case after three weeks of inactivity.
Pending a government appeal of the trial court's decision to exclude trial testimony by two government witnesses, the Sterling case has been on standby.
Sterling rocked the boat on Monday, however, asking the court to supplement the record with an email and a letter, both dated Oct. 14, 2011.
The government agreed that it should be added to the record, but insisted that it be filed under seal because "the letters deal with security files for certain individuals."
Prosecutors did not provide any explanation as to how 6-week-old correspondence is relevant to charges that Sterling leaked information six years ago.
Sterling agreed to make the filing under seal "so that the record can be complete," but informed the court that he does not agree that it should be sealed.
