LAS CRUCES, N.M. — A federal court in New Mexico dismissed a young girl’s lawsuit against the federal government for separating her from her father and deporting him in 2017; they have not seen one another since. While there is “little doubt” that the separation harmed the family, the Federal Tort Claims Act “does not give everyone who is harmed by the government a right to sue.” The court wrote that the prosecution of her father was within the government’s discretion and the actions were “taken with due care.”
