PROPERTY, ATTORNEY FEES - (En banc.) The trial court awarded plaintiffs $220,000 in attorney fees as special damages when it found that plaintiffs held a valid right to a recreational easement giving them access to the Lake Tahoe shoreline. The Nevada Supreme Court found that defendants failed to extinguish the right through adverse possession, but the lower court erroneously outlined rules for the easement's use. The high court clarified that attorney fees may be awarded as special damages only in slander of title actions. See ruling.
