Nevada Closer to Same-Sex Marriage

CARSON CITY, Nev. (CN) - Nevada state senators introduced a second bill to have same-sex marriage recognized in the Nevada Constitution.

To amend the Nevada Constitution, the Legislature must approve a bill in two consecutive years, then be approved by voters on the following ballot.

So Senate Bill 395 picks up where the state Senate left off in the 2013 session.

Although a federal appeals court lifted the ban on same-sex marriage on Oct. 9, 2014, the state Constitution still declares: "Except as otherwise provided in this section, a male and a female person... may be joined in marriage."

The bill would strike "a male and a female" and replace it with "two persons, regardless of gender."

In 2013, Senate Joint Resolution 13, recognizing same-sex marriage, passed in the Senate 12-9 and in the Assembly 27-14.

If SB395 passes, the issue will be out on the 2016 ballot.
