Nestlé out of toxic baby food class action

SAN FRANCISCO — Nestlé has been dismissed from a California class action brought by parents over the toxic heavy metals allegedly in Gerber’s baby food products, which consumers accuse of causing brain damage in children and which Nestlé procures rice for. The suing parents could not convince the court it has specific personal jurisdiction over the company, nor that it had sufficient control over the design or manufacture of Gerber baby food to be held liable.
